General Terms and Conditions (GTC) for the Sale of Perfume Samples
1. Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) through our online shop for perfume samples.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.
1.3 Deviating conditions of the customer will not be recognized unless we expressly agree to their validity in writing.
2. Offer and Conclusion of Contract
2.1 The presentation of products in our online shop does not constitute a legally binding offer, but rather an invitation to submit an order.
2.2 By clicking the "Buy Now" button, you place a binding order for the products contained in the shopping cart. The confirmation of receipt of the order occurs immediately after submitting the order and does not yet constitute acceptance of the contract.
2.3 A contract is only concluded when we accept your order through an explicit order confirmation or the dispatch of the goods.
3. Prices and Payment Terms
3.1 All prices stated are final prices and include the statutory value-added tax. Shipping costs are charged additionally and are displayed during the ordering process.
3.2 Payment can be made optionally via PayPal, credit card, instant transfer, or other payment methods offered in the online shop.
3.3 The purchase price is due immediately.
4. Delivery
4.1 We only deliver to addresses within Germany, Austria, and Switzerland. Deliveries to other countries require a separate agreement.
4.2 The delivery time is 1-5 working days, unless otherwise stated. If a product is not available, we will inform you immediately.
4.3 We are entitled to partial deliveries, as long as this is reasonable for you. No additional shipping costs will be incurred.
5. Right of withdrawal
5.1 Consumers have a fourteen-day right of withdrawal.
5.2 Withdrawal instruction:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (name, address, email address) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).
5.3 Consequences of Withdrawal:
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same payment method that you used for the original transaction, unless you have expressly agreed otherwise.
You must return the goods in undamaged packaging immediately and in any case no later than fourteen days from the day you inform us of the cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period expires. You bear the direct costs of returning the goods.
6. Return Policy
6.1 You can return products within 30 days of receipt in their unopened and undamaged original condition.
6.2 The costs for returning the goods are to be borne by the customer, unless the goods are defective or delivered incorrectly.
7. Retention of Title
7.1 The goods remain our property until full payment has been made.
8. Liability
8.1 We are fully liable for intent and gross negligence as well as for damages resulting from the violation of life, body, or health.
8.2 In the case of slight negligent violation of essential contractual obligations (obligations whose fulfillment enables the proper execution of the contract and on whose compliance the contractual partner can regularly rely), our liability is limited to the foreseeable and contract-typical damage at the time of the conclusion of the contract.
8.3 Any further liability is excluded.
9. Data Protection
9.1 Information on how we handle your personal data can be found in our [Privacy Policy].
10. Final Provisions
10.1 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention. Mandatory provisions of the state in which the customer has their habitual residence remain unaffected.
10.2 Should individual provisions of these terms and conditions be or become ineffective, the validity of the remaining provisions shall remain unaffected.
10.3 The place of jurisdiction, as far as legally permissible, is our business location.
11. Filling in our own bottles
11.1 Our perfumes are refilled into our own glass bottles. All products are filled carefully and hygienically, without compromising the quality or authenticity of the perfume. By purchasing, you confirm your agreement with this filling practice.
